BYLAW NO. 2190

Assessment and Tax Bylaw
Bylaw No. 2190 of the Municipal District of Provost No. 52 in the Province of Alberta.

A Bylaw that would provide for the imposition of fees for assessment, tax information, subdivision and development appeal board filing, road closure applications and locating and retrieving other records.

UNDER AND BY VIRTUE of the power conferred upon it by the provisions of the Municipal Government Act, being Chapter M-26.1 of the Revised Statutes of Alberta, 1994 and amendments thereto, the Council of the Municipal District of Provost No. 52 enacts as follows:

That the said Municipal District be and it is hereby authorized to charge the fees as hereafter noted:
  1. TAX CERTIFICATE
    1. Upon receipt of a fee of $15.00/roll, a Tax Certificate will be issued showing whether or not all taxes in respect of an assessable parcel of land or other property have been paid and, if not, the amount of current taxes and arrears payable against the parcel or other property; AND
    2. Upon request for further details, there shall be included in the certificate a detailed statement of arrears indicating the portion attributable to each year, at no extra cost.
    3. No fees will be charged to the owner or parties deemed to have a financial interest.
  2. STATEMENT OF ASSESSMENT AND DESCRIPTION OF PARCEL
    1. Upon receipt of a written or verbal request including a legal or other description of the parcel by which it can be located, a statement will be issued in writing showing:
      1. The description of the parcel as set out in the assessment roll; and
      2. The latest assessed value of the land and of the improvements thereon as set out in the assessment roll; AND
    2. Upon further request there shall be included in the statement, the assessments year by year, as set out in the assessment roll, for the years requested.
    3. No fees will be charged for this service.
  3. STATEMENT OF DESCRIPTION OF PARCEL
    1. Upon receipt of a written or verbal request, including a description of the parcel by which it may be located, a statement will be issued in writing showing the description of a parcel as set out in the assessment roll.
    2. No fees will be charged for this service.
  4. ASSESSMENT RECORD
    1. Upon receipt of a written or verbal request with a description of the parcel from a purchaser, person acting on behalf of a purchaser or any interested party and a fee of $5.00/parcel, the M.D. shall supply a copy of the assessment record or particulars as to the assessed value of the parcel of land or improvements. No fees shall be charged upon written or verbal request from the owner but shall be charged to anyone acting on behalf of the owner or purchaser.
    2. A further fee of $1.00 per farmland sheet will be charged to anyone to FAX or mail requests out to a maximum of $10.00.
  5. SUBDIVISION & DEVELOPMENT APPEAL BOARD FILING FEES
    (reimbursed if withdrawn or successful)

  6. ROAD CLOSURE APPLICATIONS

    All applications $100.00 plus advertising costs.

  7. LOCATING & RETRIEVING OTHER RECORDS

    $10.00 per 1/4 hour.

This Bylaw rescinds Bylaw #2000.
